TERMS AND CONDITIONS OF PURCHASE

 

Please carefully read the following terms and conditions relating to your participation in Journey Home Training which is conducted by Amanda Ananda, doing business as Experience Ananda, and David M. Rinaldi. By purchasing the Journey Home Training (the “Course”) from Amanda Ananda & David M. Rinaldi (“Coaches”), you agree and consent to the following legal terms and conditions that govern your use of the Course and that form a legal agreement between you and the Coaches.

PURCHASING REQUIREMENTS

You must be at least 18 years of age or older to purchase this Course. The Course is available for individual purchase only. Friends, family, partners, colleagues, etc, will each need to purchase the Course individually. You are expressly prohibited from sharing access to the Course with anyone else. Additionally, you have no right to assign this Agreement as this Course is non-transferable.

EARNINGS DISCLAIMER AND INDIVIDUAL RESPONSIBILITIES

This Course is not a get rich scheme. Coaches cannot guarantee any success or projected increased income from taking this Course. Although there are many happy students of the Course, many of whom have provided testimonials, their results may not be typical for everyone and they are not intended to guarantee, promise, represent and/or assure that you will achieve similar results from taking the Course. Each person’s success and results depend on many factors, including dedication, desire and motivation. You accept the risk of not achieving any results (or less than desirable results) from taking the Course.

This Course does not provide any professional financial, legal, medical or psychological services or advice. None of the content of the Course cures or treats any mental or medical condition. You are responsible for your own physical, mental and emotional well-being, decisions, choices, actions and results. Coacheses disclaims any liability for your reliance on any opinions or advice contained in the Course.

Any third party links to products or services are subject to separate terms and conditions. Coaches are not responsible for or liable for any content on or actions taken by such third party websites. Although Coaches may recommend third party sites, products or services, it is your responsibility to fully vet such third parties before entering into any transaction or relationship with them.

ATTENDEE CONDUCT

Experience Ananda reserves the right to ask me and/or my guests to leave any Event and/or hotel immediately should l/they be deemed rude, uncooperative, unprofessional, or disruptive. In such case, my fees for the respective Event or group in general will not be reimbursed.

PAYMENT

Attendees are responsible for paying for the Course in full and for providing Coaches with a valid credit card or other payment method. If the payment is declined, returned or deemed fraudulent, Attendees’ access to the Course will be terminated until all payments are made in full. If Attendee enrolled through the payment plan and misses a payment, Attendees’ access to the Course will be suspended until a valid credit card or other payment method is provided. Multiple missed payments may result in termination of Attendees’ access to the Course unless all remaining payments are made in full.

RETREAT REGISTRATION INFORMATION

First payment must be completed in full before the retreat begins to be able to attend.

TRAVEL ARRANGEMENTS

All travel arrangements are your responsibility and incur at your own cost. Experience Ananda shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel.

REFUND POLICY

Once Attendee registers for The Course, we make extensive arrangements and investments while anticipating their tuition and attendance, and, in the case of their cancellation, we incur significant administration hassles, expenses, and loss of business. Given this fact, we do not accept cancellations or issue refunds within a week of the Retreat. Prior to one week out, 50% of ticket price will be refunded.When requesting a refund, please include a copy of your invoice or confirmation number in your email. If you do not have either of these, please include your first and last name, billing address if you entered it when ordering, email address and phone number. Refunds for the price of the product will be made within 30 days after the refund request has been received. Refunds are made to the purchasing credit card. If the card has expired, please let us know the new expiration date in order to expedite your refund.

IMPORTANT NOTE ON DIGITAL RETURNS/REFUNDS: When ordering my digital products from Amazon.com, iTunes or a similar company, please refer to that company’s customer support and return/refund policies.www.thetantricmama.com reserves the right to refuse returns and replacements purchased from another company and directed to us. If you’re experiencing customer support issues with another company, please call and speak with us before returning their product to us. We’ll try to rectify the situation and save us both some time and postage.

INTELLECTUAL PROPERTY

This Course includes materials protected by copyright, trademark and other intellectual property laws. Such materials include but are not limited to written text, workbooks, videos, audio recordings, photos, designs and graphics. Any reproduction or unauthorized use shall constitute infringement. Duplicating, sharing or uploading Course files to sharing sites is considered stealing and Coaches may prosecute such misconduct to the fullest extent permitted by law.
Coaches provide you with this Course solely for your personal, noncommercial use and you agree that you will not use such proprietary information or materials in any way whatsoever except for use in compliance with this Agreement. You will not use the Course in a manner that constitutes infringement or that has not been authorized by Coaches. More specifically, you may view, download, print, email and use these materials for your personal, noncommercial purposes only. You may not republish, reproduce, duplicate, copy, display, distribute or otherwise use any material from the Course for commercial purposes. Additionally, you may not modify, republish, upload, post, transmit, rent, lease, loan, translate, sell, create derivative works, exploit or distribute in any manner or medium, including by email or other electronic means, any material from the Course.

PRIVACY

Coaches and their third party vendors may collect information from you when you purchase the Course, fill out any type of form, access private membership pages, or otherwise contact Coaches via an online form, e-mail or through social media. The information collected may include your name, e-mail, address, phone number, and billing information.
Coaches collects such information in order to send e-mails, fulfill orders, deliver services and products, complete customer transactions, oversee promotions and improve website performance and customer service.
By purchasing the Course, you will be subscribed to Coaches’ e-mail list if you are not already a subscriber. If you wish to unsubscribe from receiving e-mails from Coaches unrelated to the Course, you may do so at any time. Each e-mail from Coaches includes a link to unsubscribe from e-mail communications. Just be certain to not unsubscribe from the Course list or you will no longer receive information and course materials related to the Course purchased.
Coaches respect your privacy and will never sell, trade or transfer your personally identifiable information to third parties for marketing or advertising. Coaches may, however, share your information with third party service providers working on Coaches’ behalf to serve you. Examples include companies and individuals we have engaged to maintain and update websites, private membership sites or e-mail platforms or to process financial transactions. Coaches may also be required by law to release information in certain circumstances.
Please note that any comments or information that you post on the Course website, including any private membership sites and private Facebook groups, are not private and third parties may make use of your information. Coaches are not responsible for any unauthorized uses by third parties in such context.
Any third party links to products or services are subject to separate privacy policies. Coaches are not responsible for or liable for any content on or actions taken by such third party websites.
This Course is targeted and intended for persons over the age of 18. Coaches do not knowingly collect information from anyone under 18 years of age.
Coaches may collect domain information and “cookies” (small files saved on your hard drive by your web browser) to analyze website and advertisement performance, track user patterns, save information from your previous visits and customize your experience.

 FORBIDDEN ACTIVITIES

You are strictly forbidden from the following:
• Causing damage to the Course website or private membership site
• Using the Course website or private membership site for any unlawful, illegal, fraudulent or harmful purpose or activity
• Using the Course website or private membership site to copy, store, host, transmit, send, use, publish or distribute any spyware, virus, worm, Trojan horse, keystroke logger or other malicious software
• Using the Course website or private membership site to transmit, send or deliver unsolicited communications or for other marketing or advertising purposes
• Systematically or automatically collecting data from the Course website or private membership site
• Sharing private, copyrighted and proprietary information from the Course with anyone else or otherwise sharing your username and/or password

PRIVATE FACEBOOK GROUP

Every term and condition of this Agreement equally applies to any activities in the private Facebook group created for members of the Course (the “Group”). The Group is a complimentary bonus and subject to Facebook terms and conditions. Coaches do not have authority or control over Facebook and cannot predict any changes or rules to Facebook. Coaches are not liable for the Group being made available to you or your rights to access Facebook. Additionally, Coaches may institute community rules and guidelines for the Group with which you agree to comply.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Coaches and their agents and contractors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party.

HEALTH DISCLAIMER

We will be dancing and light yoga and other movement practices everyday. Anyone with a reasonable level of fitness will be able to fully enjoy both the dance & yoga practice, however, this training may not be suitable for anyone who has serious physical/medical conditions. If you have had any serious physical or emotional illness within the last 5 years, or are under medical or psychiatric supervision please advise us at the time of registration. If you are in any doubt about your ability to participate in this training, please contact us beforehand to discuss this. Please ensure that you have adequate travel insurance to cover you for your retreat.

LIABILITY WAIVER

While we take every possible measure to ensure Attendee’s safety at the Journey Home Retreats, we cannot control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements:

I, the willing Attendee of Journey Home Retreats, hereby accept all risk to my health and of my injury or death that may result from participating in the Course & Retreats and I hereby release Amanda Ananda, Experience Ananda, LLC, David M. Rinaldi, and their officers, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at Journey Home Retreats, whether caused by negligence of Amanda, her staff, officers, employees, or representatives, or otherwise. I further agree to indemnify and hold harmless Amanda Ananda and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in Journey Home Course and/or Retreats. Under no circumstances will Coaches or their assigns be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in Journey Home Course and/or Retreats. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in Journey Home Course and/or Retreats, I consent to such treatment. I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify Coaches verbally and in writing if I am at any time injured prior to, during, or after Journey Home Retreats in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Coaches are not legally obligated to act on that information in any way or to providing any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in Journey Home Course and/or Retreats that I will notify Coaches and that Coaches retain the right to ask that I not participate in portions of or the entirety of Journey Home Course and/or Retreats.
Coaches will not accept any responsibility for cancellations, delays or changes caused by war, threat of war, terrorist actions, closure of airports, civil strike, industrial action, natural disasters, technical problems to transport, illness of participants or close relatives/pets, acts of God or any other events beyond our control. Neither can we be responsible for any loss or damage of property or disruption of program due to circumstances beyond the control of Coaches.

 

LIABILITY DISCLAIMER: NO PROFESSIONAL ADVICE
The information contained in or made available by Amanda Ananda, David M. Rinaldi or any third-party through the Course or The Tantric Mama Website or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, or legal fields. Amanda & David do not offer any professional personal, medical, financial or legal advice and none of the information contained in the Course should be confused as such advice. Neither Amanda, David, or their assigns, sponsors, speakers, partners, contractors or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages to the Attendee or the Attendee's business, including economic loss, that may result from participation in the Course or from the use of, or the inability to use, the materials, information, or strategies communicated through the Course or any products or services provided pursuant to the Course, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will Experience Ananda, LLC be liable for any special or consequential damages that result from Attendee's participation in Journey Home Course and/or Retreats. To be clear: You, the Attendee, alone are responsible and accountable for your decisions, actions and results in life, and by your participation in the Course, you agree not to attempt to hold us, Amanda, Experience Ananda, LLC or David M. Rinaldi liable for any decisions, actions or results that you make or experience in business or in life due to your participation in the Course at any time, under any circumstance.

CONFIDENTIALITY AND NON-COMPETE

Attendee hereby understands that the tools, processes, strategies, materials and information presented in the Course are confidential, copyrighted, and proprietary to Coaches and agrees not to record, duplicate, distribute, teach or train from the Course materials in any manner whatsoever without the express written permission from Coaches. Attendees may not use any device to video, photograph, or record any aspect of Journey Home Course or Retreats. Attendees who do not abide by this policy will be asked to destroy any recorded materials and may be asked to leave Journey Home Course and/or Retreat and will not be eligible for a refund. Any unauthorized use or distribution of the proprietary concepts, materials, and intellectual property by the Attendee or his/her representatives is prohibited and Coaches will pursue legal action and full damages if these terms are violated in order to protect their rights.

CONFIDENTIALITY
To access certain features of the Course, you may need a username and/or password. You agree to keep this information confidential and not share it with anyone else. If Coaches have reasonable grounds to suspect that you have shared your username and/or password with anyone else, or forwarded course material to any other person, Coaches have the right to suspend or terminate your account and refuse any and all current or future use of the website and online courses, in whole or part, without refund.

ADULT LANGUAGE
During the Course and Retreats, we will discuss several adult topics relating to personal growth and physical intimacy and pleasure. We will also sometimes use adult or profane language to emphasize a point or connect with or surprise the audience. Given the adult topic and content, Coaches do not allow anyone under the age of eighteen (18) into the Course unless accompanied by a parent or legal guardian. Participants who are uncomfortable with such topics or language should not attend the Course and/or Retreats and will not receive a refund should they request one based on an offense to such language or topics under any circumstances.

AUDIO/VISUAL RELEASE
I hereby expressly grant Experience Ananda, LLC and to its officers, employees, agents, and assignees, the right to use photographs, video testimonials, video takeaways, and other presentations of me recorded by Experience Ananda, LLC during my participation in the events, and to use the photographs, my voice and picture contained within any such video, my silhouette, and other reproductions of physical likeness and class-related work, in connection with or as part of any presentation, program, publication, product, or other professional endeavor in which the same may be used or incorporated, and also in the advertising, and/or publicizing of any such works, in perpetuity. I understand that these images/sounds may be used for commercial, educational or informational purposes. I waive all rights of copyright, ownership, and rights of publicity in or the resulting commercial or educational and informational materials in which I appear. Any facts, figures, testimonials, stories, etc. I give are truthful and are freely given without payment.

DISCLAIMER OF WARRANTIES AND LIMITATIONS OF LIABILITY
We've taken every effort to ensure we accurately represent this event and its potential to help you improve your relationship to self. However, there is no guarantee that you will have specific results. Nothing on this page is a promise or guarantee of results. Your level of success in attaining results is dependent upon a number of factors including your skill, knowledge, ability, dedication, relationship savvy, and romantic situation. Because these factors differ according to individuals, we cannot guarantee your success. You alone are responsible for your actions and results in life and relationships. COACH DOES NOT WARRANT THAT THE COURSE WEBSITE OR ANY OF ITS FUNCTIONS WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PART OF THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
COACHES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR OUT OF YOUR USE, INABILITY TO USE, OR PURCHASE OF THE COURSE. YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE COURSE. NOTWITHSTANDING THE FOREGOING, ANY DAMAGES SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE COURSE. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITED OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS THE COACH’S LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Connecticut, without giving effect to its conflict of laws. The state and federal courts located in Hartford, Connecticut shall have exclusive jurisdiction over any case or controversy arising from or relating to the Course. You hereby submit to the exclusive jurisdiction and venue of such courts and consent irrevocably to personal jurisdiction in such courts and waives any defense of forum non-conveniens.

CONSTRUCTION OF AGREEMENT
This Agreement constitutes the entire understanding and agreement of the parties with respect to its subject matter and supersedes all prior and contemporaneous agreements or understandings, inducements or conditions, express or implied, written or oral, between the parties.
In the event that any provision of this Agreement is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from the Agreement, such determination shall not affect the validity and enforceability of any other remaining provisions.
The failure of Coaches to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. Any ambiguities in the interpretation of the Agreement shall not be construed against the drafting party.
